At Michael Sundell Coaching, I am committed to protecting the privacy and security of your personal information. As an independent practitioner operating in Quebec, I adhere to the Act respecting the protection of personal information in the private sector (Law 25). This policy outlines how I collect, use, and safeguard your data.
1. Privacy Officer
Under Law 25, every organization must designate a Privacy Officer. I, Michael Sundell, act as the Privacy Officer for my practice. If you have any questions, concerns, or requests regarding your personal information, please contact me directly at michael@michaelsundellcoaching.com.
2. Information I Collect
I collect personal information only when necessary, and only for the specific purposes described below:

Website Visitors: If you use my contact form, I collect your name, phone number, email address, and the content of your message solely to respond to your inquiry. Contact form submissions that do not result in a coaching relationship are deleted within twelve (12) months.

Coaching Clients: In addition to contact information, I maintain records relevant to our coaching relationship, including session notes and administrative details. These records are collected to support continuity of care, track progress toward your goals, and fulfill administrative obligations related to our coaching relationship.
Consent
Consent for the collection and use of your personal information is obtained through your signed Coaching Agreement prior to our first session. For website visitors using the contact form, submitting the form constitutes consent to use your information to respond to your message. You may withdraw consent at any time by contacting me directly, subject to any legal or contractual obligations.
3. Digital Privacy and Data Handling
I prioritize the security of the information shared during our sessions.

Digital Tools: I utilize secure digital tools, specifically Zoom (for video conferencing and AI-assisted transcription) and Microsoft OneNote (for secure record-keeping).

Data Processing: These tools process and store session information on cloud-based servers. I take all reasonable measures to ensure that AI features are configured to protect your privacy and that your data is not used for third-party model training purposes.

Data Location: Zoom and Microsoft OneNote store data on servers located outside of Quebec, including in the United States. Before using these services, I confirmed that both providers maintain privacy and security standards that offer protection comparable to Quebec law. Client Control: If you are a client, you maintain the right to request that a specific session not be recorded or transcribed, and you may request that your digital records be deleted at any time, subject to legal record-keeping requirements.
4. Data Retention
I retain personal information only as long as necessary for the purposes for which it was collected. Client records are retained for a period of seven (7) years following the end of our coaching relationship, in accordance with standard professional record-keeping practices. When information is no longer required, it is securely deleted or destroyed.
5. Data Security and Third Parties
I do not sell, rent, or trade your personal information to third parties. Your data is accessed only by me for the purpose of delivering coaching services. While I utilize reputable, industry-standard third-party services (Zoom and Microsoft), I regularly monitor their security practices to ensure they align with my commitment to your privacy.
Privacy Incidents: In the unlikely event of a confidentiality incident involving your personal information, I will assess the risk of harm and notify affected individuals and the Commission d’accès à l’information (CAI) as required by law. I maintain a record of all confidentiality incidents as required under Law 25.
6. Your Rights
Under Quebec law, you have the right to:

Access: Request access to the personal information I hold about you.

Rectify: Request that I correct any inaccurate or incomplete information.

Withdraw Consent: Withdraw your consent for the use or disclosure of your information (subject to the terms of your signed Coaching Agreement).

Deletion: Request the deletion of your personal information, provided it does not conflict with legal record-keeping obligations.

Portability: Request that I provide you with the personal information you have provided to me in a structured, commonly used technological format, where technically feasible.

If you feel that your privacy rights have not been respected, you have the right to file a complaint with the Commission d’accès à l’information du Québec (CAI) at www.cai.gouv.qc.ca or by calling 1-888-528-7741.
7. Updates to This Policy
I may update this policy periodically to reflect changes in my practice or legal requirements. The “Last Updated” date at the top of this page will always indicate when the most recent changes were made.
